uPlayMe, Inc. ("uPlayMe") realizes that your privacy is incredibly important. We feel the same way about our privacy! This Privacy Policy outlines the types of information we gather when you use the uPlayMe Service, as well as some of the things we do to safeguard it.

uPlayMe is a service that collects information from your computer about the songs you're listening to, the video's that you watch, the podcasts you listen to, and other entertainment files that you are using. The purpose of collecting that information is to enable you to get matched with people who are listening to and looking at the same stuff. In other words, uPlayMe uses that information to find people who have similar tastes to you. Chances are you will have lots to talk about if you're listening and watching the same stuff.

This Privacy Policy describes the use by uPlayMe of the personally identifiable information given to us by users of our service. It's important for you to realize that by using uPlayMe, you agree to be bound by the terms and conditions of this Privacy Policy. If you do not agree with this Privacy Policy, please do not use or access our service.

1.0 Information that we collect

uPlayMe collects the following information from you, and you need to give it to us in order to use our service effectively:

1. email address,
2. password,
3. a user name (which should not be your real name),
4. your age,
5. your sex,
6. your zip code, and
7. your personal website addresses (which is optional).

We also are collecting information about the songs, videos, and other digital entertainment files you play through software like iTunes™ and Windows Media Player™. We do not collect financial information, your social security number, credit card number or any other personally identifiable information like your name, and we do not look at the content of any communication between you and another uPlayMe member. uPlayMe employees will never ask for that kind of information. However, we do collect information about your use of your computer and our service. We need this information in order to operate the uPlayMe Service, but we do not share it with anyone. If we ever did contemplate sharing it, we would ask your permission first.

uPlayMe also logs non-personally-identifiable information including IP address, profile information, aggregate user data, and browser type, from users and visitors to the site. This data is used to manage the website, track usage and improve the website services, among other things. This non-personally-identifiable information may be shared with third-parties to provide services and advertisements to members. User IP addresses are recorded for security and monitoring purposes.

2. How will this information be used?

We will use your email address and password to authenticate your use of the service. We will use your username (which should not be your real name) to allow uPlayMe and other members to identify who you are. They will not see your real name at any time unless you give it to them through via instant messenger or in an email. They will not see your email unless you use uPlayMe to send them an email, in which case the recipient WILL see your email address which will enable them to respond. So don't send someone an email through uPlayMe unless you want them to see your email address and respond. If you optionally choose to let people contact you via email, uPlayMe will send the email and the sender will not know your email address UNLESS YOU RESPOND to that email.

We use the information about the music and other digital entertainment files you play to enable the service to match you with other people playing the same songs, videos, etc. Without that information, uPlayMe wouldn't work. This information is stored on our servers in secure databases, and is not used for any other purpose other than to match you with other uPlayMe users. The data is also not linked to any personally identifiable information other than that discussed above.

The information is retained for a period of a 3 to 12 months, even if you decide to stop using the service. Following that period, the database removes inactive users along with any information we may have collected.

Except as otherwise described in this privacy policy, uPlayMe will not disclose personal information to any third-party unless we believe that disclosure is necessary:

1. to conform to legal requirements or to respond to a subpoena, search warrant or other legal process, whether or not a response is required by applicable law;
2. to enforce the uPlayMe Terms of Use Agreement or to protect our rights; or
3. to protect the safety, security and livelihood of members of the public and users of the service.

uPlayMe reserves the right to transfer personal information to a successor in interest that acquires rights to that information as a result of the sale of uPlayMe or substantially all of its assets to that successor in interest .For more information see the "Changes to this Statement" section below. If we do ever contemplate making changes, we would send you notice of that.

2.0 Security

uPlayMe accounts are secured by member created passwords, and we take precautions to insure that this information is kept private. We use standard and commercially viable methods to protect this information, such as putting it behind multiple levels of firewalls, with active intrusion detection systems.

3.0 Third-Party Advertising

Ads appearing on uPlayMe application may be delivered to users by us or one of our advertising partners. Our advertising partners may place cookies on your computer. These cookies allow the ad server to recognize your computer each time they send you an online advertisement. In this way, ad servers may compile information about where you, or others who are using your computer, saw their advertisements and determine which ads are clicked on. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you.

4.0 Changes to This Statement

We may amend this Privacy Policy at any time by posting the amended terms on our website. All amended terms shall automatically be effective 30 days after they are initially posted on the Site. If we make material changes to this policy, we will notify you here, by email, or by means of a notice on our home page.

5.0 Control of Your Password

You are responsible for all actions taken with your user name and password. We recommend that you not disclose your password to anyone. If you choose to share your user username and password with third parties, you are responsible for all actions taken with your account. If your password has been compromised for any reason, you should immediately change your password.

6.0 Collecting Information From Children

Personal information is not knowingly collected from children under the age of thirteen (13) and we ask that minors (under the age of 13) do not submit any personal information to us.
